By accessing or using BioInfera's platform and services, you agree to be bound by these Terms of Service and all applicable laws and regulations, including those governing research and data privacy (e.g., HIPAA, GDPR).

These terms constitute a legally binding agreement between you and BioInfera Inc. ("BioInfera," "we," "us," or "our"). Your continued use of our services constitutes acceptance of any modifications to these terms.

2. Eligibility

To use our services, you must be:
  • A researcher, clinician, or student affiliated with a recognized academic, medical, or research institution.
  • Authorized by your institution to conduct research and handle sensitive data.
  • In compliance with all applicable laws and regulations in your jurisdiction.
  • At least 18 years of age.
Important: BioInfera services are intended for research use only and are not for direct clinical diagnostic use unless explicitly stated.

4. Account Registration and Security

Registration Process

To create an account, you must provide accurate, current, and complete information, including your institutional affiliation and research credentials.

Account Security
  • You are responsible for maintaining the confidentiality of your account credentials.
  • Enable two-factor authentication for enhanced security.
  • Notify us immediately of any unauthorized access or security breaches.
  • Use strong, unique passwords and update them regularly.
  • Do not share your account with unauthorized individuals.
Security Notice: You are fully responsible for all activities that occur under your account. BioInfera is not liable for losses resulting from unauthorized account access due to compromised credentials.

5. Data and Research

Data Ownership

You retain ownership of all genomic data and research materials you upload to the BioInfera platform. We do not claim any ownership rights to your data.

Data Usage
  • You grant BioInfera a limited license to use your data to provide our services, including running analyses and generating results.
  • We may use de-identified, aggregated data to improve our platform and services.
  • We will not use your data for any other purpose without your explicit consent.
Compliance

You are responsible for ensuring that your use of the platform and your data complies with all applicable laws, regulations, and institutional policies, including those related to patient privacy and data sharing.

6. Disclaimer of Warranties

Research Use Only

The BioInfera platform and its outputs are intended for research use only and should not be used for clinical diagnosis or treatment decisions. Interpretations of data are the sole responsibility of the user.

7. Fees and Payments

Service Fees

BioInfera charges fees for various services as outlined in our pricing schedule. Fees may include subscription fees, compute credits, and charges for custom bioinformatics services.

Compute Credits Pay-as-you-go for GPU resources
Custom Services Project-based fees for custom analysis

Fees are subject to change with 30 days' notice. Current fee schedules are available in your account dashboard and on our website.

8. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

Data Violations
  • Uploading identifiable patient data without proper consent
  • Violating data privacy regulations (HIPAA, GDPR)
  • Infringing on intellectual property rights
System Abuse
  • Hacking or unauthorized access
  • Reverse engineering or tampering
  • Excessive API usage or abuse
  • Disrupting platform operations

9. Termination

Termination by You

You may terminate your account at any time by providing written notice. Upon termination, you remain responsible for all fees incurred.

Termination by BioInfera

We may suspend or terminate your account immediately for violation of these terms, illegal activities, or other reasons that pose a risk to our platform or other users.

10. Limitation of Liability

Service Disclaimer

BioInfera services are provided "as is" without warranties of any kind. We do not guarantee uninterrupted service, error-free operation, or the accuracy of research findings. Your use of our services is at your own risk.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIOINFERA SHALL NOT BE LIABLE FOR:

  • Incorrect research conclusions or data interpretations
  • System downtime or technical failures
  • Data loss or corruption
  • Consequential, indirect, or punitive damages
Indemnification

You agree to indemnify and hold BioInfera harmless from any claims, losses, or damages arising from your use of our services, violation of these terms, or infringement of any third-party rights.
